Trademark Process in India
Registering a trademark in India is crucial for protecting your brand identity and distinguishing your goods or services from others in the marketplace. The process involves several key steps :

1. Trademark Search
Conducting a comprehensive trademark search to ensure your proposed trademark is unique and does not conflict with existing trademarks registered or applied for in India.

2. Filing the Trademark Application
Submitting a trademark application to the Trademark Registry. The application includes details such as the trademark, applicant’s details, goods/services covered, and a statement of first use (if applicable).

3. Examination
The Trademark Office examines the application to verify compliance with legal requirements and checks for any conflicts with existing trademarks. If any objections arise, the applicant must respond within the stipulated timeframe.

4. Publication
Upon acceptance of the trademark application by the Trademark Office, the trademark is published in the Trademark Journal. This allows third parties to oppose the registration within a specified period (usually 4 months).

5. Opposition Proceedings
If an opposition is filed by a third party, the applicant must respond accordingly. Legal Deed assists clients in preparing counter arguments and evidence to defend their trademark rights during opposition proceedings.

6. Registration
If no opposition is received or successfully overcome, the trademark proceeds to registration. The registration certificate is issued by the Trademark Registry, providing exclusive rights to use the trademark for the specified goods/services.

7. Renewal and Maintenance
Trademarks in India are initially registered for 10 years and can be renewed indefinitely. Legal Deed offers services for trademark renewal and maintenance to ensure continued protection of our clients’ brands.
