Patent Process in India

1. Patentability Search

2. Patent Drafting

Drafting a patent application that clearly describes the invention, its features, and how it works. The application must comply with legal requirements and be supported by detailed drawings (if applicable).

3. Filing the Patent Application

Submitting the patent application to the Indian Patent Office (IPO). The application includes details about the inventor(s), title of the invention, abstract, and technical specifications.

4. Publication and Examination

The patent application is published in the Patent Office Journal after 18 months from the filing date or priority date (if claimed). Subsequently, the application undergoes substantive examination to assess patentability criteria.

5. Responding to Examination Reports

6. Grant of Patent

If the application meets all requirements and objections are resolved satisfactorily, the Patent Office grants the patent. A patent certificate is issued, providing exclusive rights to the inventor to prevent others from making, using, selling, or importing the patented invention.

7. Maintenance and Renewal
